PROPERTY- Junior Law Program

This course explores the legal doctrines, principles, and policies that govern the acquisition, ownership, transfer, and regulation of real and personal property in the United States. It delves into both common law foundations and modern statutory frameworks that shape rights in land and other resources. Students will learn how property law balances individual rights against public interests, manages scarce resources, and addresses issues of fairness, efficiency, and social policy.

Core areas of focus include the nature of property rights, estates in land, present and future interests, landlord-tenant law, adverse possession, concurrent ownership, servitudes, land use controls, and takings. Throughout the course, students will examine how legal reasoning in property cases interacts with social, historical, and economic realities.

Course Objectives

By the end of the course, students will be able to:

1. Explain the foundational concepts and philosophical justifications underlying property law.

2. Distinguish among different types of estates and interests in both real and personal property.

3. Analyze common law and statutory frameworks governing acquisition, possession, and transfer of property.

4. Evaluate the legal and equitable doctrines that govern land use, servitudes, and zoning.

5. Apply key doctrines such as adverse possession, the rule against perpetuities, and eminent domain.

6. Critically assess modern challenges in property law, including housing rights, gentrification, environmental land use regulation, and digital property.
