PROFESSIONAL RESPONSIBILITY- Junior Law Program

This course explores the ethical and professional obligations of attorneys in the American legal system. Through analysis of the American Bar Association (ABA) Model Rules of Professional Conduct, Restatement (Third) of the Law Governing Lawyers, and relevant constitutional principles, students will gain a deep understanding of the role of the legal profession in a democratic society.

The course emphasizes how lawyers navigate ethical conflicts, uphold their duties to clients, courts, third parties, and the public, and manage the complex interplay between professional ethics, business pressures, and personal morality. Topics include confidentiality, conflicts of interest, advertising, competence, client misconduct, the adversarial system, and the disciplinary process.

Course Objectives

By the end of this course, students will be able to:

1. Understand and apply the ABA Model Rules of Professional Conduct to real-world ethical scenarios.

2. Identify and resolve ethical conflicts between duties owed to clients, courts, and third parties.

3. Explain the scope and limits of lawyer-client confidentiality, attorney-client privilege, and duty of candor.

4. Analyze the regulation of the legal profession, including bar admission, discipline, and unauthorized practice.

5. Critically evaluate the ethical implications of emerging practice settings, including in-house counsel, public interest law, and virtual legal services.

6. Apply ethical reasoning to complex fact patterns in litigation, transactional, and advisory practice.
