NEGOTIATION AND MEDIATION- Junior Law Program

This course explores the law, theory, and practice of negotiation and mediation as fundamental tools for resolving legal disputes and achieving client goals. Emphasizing both adversarial and collaborative models, the course examines how attorneys negotiate contracts, settle lawsuits, and mediate conflicts across civil, commercial, family, and community contexts. Students will explore the psychological dynamics of bargaining, ethics of settlement, interest-based vs. positional approaches, and the role of lawyers in third-party neutral forums.

The course combines strategic negotiation planning, legal analysis of mediation frameworks, and interdisciplinary insights from behavioral science to equip students with the capacity to negotiate skillfully and advocate effectively in mediations.
