This course provides an in-depth, practical exploration of the discovery obligations imposed on foreign entities involved in U.S. litigation, especially in federal courts. Participants will examine the intersection of U.S. discovery laws—including the Federal Rules of Civil Procedure—with foreign data privacy regimes, state secrecy laws, and multijurisdictional corporate structures. The course emphasizes real-world compliance strategies, cross-border coordination, and litigation readiness for global in-house counsel and corporate legal departments.
Course Objectives:
By the end of this course, participants will be able to:
1. Navigate U.S. discovery rules and how they apply to foreign litigants.
2. Design and implement discovery compliance systems for foreign subsidiaries and affiliates.
3. Identify and resolve cross-border conflicts between U.S. demands and foreign privacy laws (e.g., GDPR, blocking statutes).
4. Strategically manage document production, depositions, and Rule 30(b)(6) preparations for foreign witnesses.
