This intensive law course explores the practical and legal challenges of cross-border insolvency and international asset recovery in a global commercial environment. It covers the interplay between domestic insolvency regimes and international cooperation mechanisms, with an emphasis on the UNCITRAL Model Law on Cross-Border Insolvency, U.S. Chapter 15, foreign recognition, and multinational restructuring efforts.
The course provides in-depth, hands-on training in litigating and managing cross-border insolvency proceedings, tracing and recovering assets across jurisdictions, protecting creditors’ rights, coordinating with foreign courts and insolvency practitioners, and navigating fraud, concealment, and enforcement obstacles in complex multinational cases.
